Provided that any reserve has been attained and any deposit required is paid immediately thereafter the highest bidder shall be the purchaser and upon the fall of the hammer shall be bound by these terms and conditions of sale. The Auctioneers decision shall be final and if he cannot decide who was the last and best bidder he may resubmit the lot.

The Auctioneer reserves the right to accept or reject a bid at his discretion and at any time to withdraw any lot from the sale.

If required by the Auctioneer a cash deposit of 10% or $500.00 whichever being the greater amount of each lot is required on the fall of the hammer.

Unless prior credit arrangements have been made with the Auctioneer, all purchasers must be completed in cash and lots removed from the Auctioneer’s premises within 48 hours of the auction.

If any purchase is not so completed any deposit shall be forfeited and the Auctioneer may terminate the sale and thereafter resell the lot and the deficiency if any, arising on such resale and all expenses of and incidental to such resale or attempting resale and the purchases default shall be recoverable by the Auctioneer as liquidated damages.

If delivery is made prior to payment, title will not pass until payment is received and in the case of a cheque, it has been cleared.

Each lot is sold subject to all faults and defects disclosed by the Auctioneer. The Auctioneer gives no guarantee as to the correctness of his description on any lot, including its stated Year model.

Each lot will be at the purchaser’s risk in all respects from the instant it leaves the Auctioneer’s premises.

Each lot sold to a private buyer by the Auctioneer (Excluding commercial vehicles or any Vehicle registered within 28 days) is subject to a "Road Worthy Certificate" at the time of delivery. If these conditions cannot be met "ALL" monies will be refunded in full or transferred to another vehicle purchased.
